What guarantees do I have during the off-plan and construction of the property?

When you purchase off-plan property in Marbella with RGZ Developers, we follow a clear and secure process to protect your investment:

1. Reservation

  • You select your unit in one of our developments and sign a reservation agreement.
  • You pay a reservation deposit, which is held in escrow by a bank.

2. Building permit & Private Purchase Contract (PPC / Arras)

  • Once the building licence is granted by the town hall, we invite you to sign the Private Purchase Contract (PPC), also known as the Arras contract. This is one of the strongest forms of purchase contracts in Spain, providing the buyer with extensive protection.
  • At this stage, you pay 40% of the purchase price plus VAT, less the reservation deposit. For this 40% stage payment, you receive a bank guarantee for your funds. If, for any reason, the project cannot be completed, the bank guarantees and refunds all amounts you have paid under the contract, in accordance with Spanish law on off-plan purchases.

Your off-plan investment with RGZ is protected by bank guarantees and a transparent payment structure, ensuring a high level of security.

What guarantees do I have upon completion and after completion of my property?

When construction is complete on your new-build home in Spain, several official checks and procedures occur before you receive the keys:

  1. Municipal inspection

    • The local town hall performs a technical inspection of the development.
    • They verify that the building complies with current regulations, matches the approved plans, and that all required insurances are in place.

  2. Licencia de Primera Ocupación (LPO)

    • If everything is in order, the town hall issues the LPO (Licencia de Primera Ocupación / First Occupancy Licence).
    • Once this licence is granted, we invite buyers to inspect their property and proceed to completion at the notary.

  3. Support before and after completion

    As your Marbella real estate developer, RGZ assists you before handover with:
    • Furniture packages and interior options
    • Connections for water, electricity, and internet
    • Practical guidance for moving in and settling into your new Costa del Sol property

  4. Community of owners

    • At completion, a community of owners is formally established.
    • Every owner has a vote in the community.
    • A community president is elected to represent all owners in communications with the developer and the builder.
    • The community makes decisions on common areas, maintenance budgets, and community rules.

  5. Post-completion guarantees

    From completion, the following legal warranties typically apply to your new-build property in Spain:
    • 10 years on the structural elements of the building
    • 3 years on mechanical installations/systems
    • 1 year on finishes and minor defects.

Why is buying off-plan with RGZ a good idea?

When we acquire land for our new-build developments in Marbella, we purchase only land officially classified as URBAN. This ensures:

  • The land is officially classified as building land.
  • There are clear planning regulations regarding:
    • Maximum building height
    • Buildable square metres (sqm)
    • Number of units
    • Type of property allowed (apartments, villas, townhouses, etc.)


Our in-house RGZ Architecture Studio designs a project according to these planning parameters and submits it to the municipality to obtain the building licence.

On average, this process takes 8 to 12 months. Once the licence is granted, we start construction within a few months.

    • During the off-plan phase, buyers typically purchase properties at 20–30% lower prices than they would after construction has started.
    • As construction progresses, prices usually increase, and most developments especially in marbella are fully or almost fully sold several months before completion.

  2. Secure reservation conditions
    • Before the building licence is in place, you only pay a reservation deposit:
      • €20,000 + VAT for units under €2M
      • €100,000 + VAT for units above €2M
    • This deposit is bank guaranteed and will be deducted from your main payment at contract signing.

  3. Strong purchase contract & bank guarantees
    • Once the building licence is granted, we invite you to review your reservation and the options you have chosen. We then sign the Private Purchase Contract (PPC / Arras). At this moment, you pay 40% + VAT, with the reservation deposit deducted. This 40% payment is fully secured by a bank guarantee, providing strong protection for your funds.

  4. Completion, LPO, and structural insurance
    • Before completion, the municipal technical department verifies that the building:
      • Matches the approved plans
      • Meets all quality and safety standards
      • Has the mandatory 10-year structural insurance in place


Once approved, the LPO (First Occupancy Licence) is issued.

After the LPO is granted, we invite you for a snagging inspection of your property before signing at the notary and completing the purchase.
